WHAT YOU GET FOR YOUR ATTORNEYS FEES

New clients often inquire as to what they are actually getting in return for payment of attorneys fees for eviction cases.  Depending on the county in which the property is located, fees may vary.  However, most counties have a set Eviction fee.  It is a common misconception that the Eviction fee only gets the client the bare bones service of removing the resident from the property.  This could not be further from the truth.  The truth is that the fee provides the client with numerous services.

1.    THE BASIC EVICTION. 
Most importantly, the Eviction fee provides the client all of the legal work and costs associated with the legal work necessary to get the non-paying or non-complying resident out of the property.  This includes the following:

    * the preparation of all court paperwork and assistance drafting eviction notices
    * the payment of the filing fee and the costs of serving the court papers
    * all attorney time, including trials (some Firms charge extra for trials)
    * the preparation of the writ of restitution and the costs of serving the writ (the Sheriff’s fee is the only cost not included)
    * legal advice on all eviction and non-eviction services
    * value-added services

Bottom line is the basic Eviction fee provides you with all the attorney services and costs necessary to evict your non-paying/non-complying resident.

2.    LEGAL ADVICE.
  Management companies cannot evaluate “eviction fee” price without factoring into consideration legal bills for routine legal advice.  Our clients regularly seek eviction related and a wide range of other general property management legal advice from HTS.  The cost for this needed and critical legal advice is easy to calculate.  The cost is $0.00.
Many law Firms have an extra charge for providing basic legal advice to their clients.  This means that when a client calls the attorney with legal questions about a particular eviction case or has general questions about the legal process, the attorney charges on an hourly basis, resulting in thousands of dollars per year in attorneys fees.  At Hopkins Tschetter Sulzer, the client is not charged for this type of legal advice because we view this as being a part of the overall Eviction fee.

We realize that if a client hesitates in calling the attorneys with a legal question because they did not want to incur hourly charged legal fees, it could lead to serious legal ramifications for the client.  Therefore, we encourage our clients to call us with any legal questions so that they can make the right decision is dealing with problem situations.

The amount of attorney time spent on these situations is not insubstantial.  While some situations can be handled in 15 minutes or less, many situations require considerably more attorney time. We are the only Firm that has developed a comprehensive “situation database” to respond to our clients’ every need for critical and timely advice.  We have eight full time attorneys and eight legal assistants to make sure that our clients get answers to their questions quickly.  We employ a full time “situation manager” whose only job is to coordinate and facilitate the handling of our clients’ issues and need for timely legal advice.  All calls and inquiries are promptly handled.

3.    DRAFTING EVICTION NOTICES.
  Most of our clients are pros at drafting eviction notices and this is especially true with rent notices.  Rent notices are usually pretty straightforward.  Compliance notices can be a little tricky.  We have seen cases where improperly drafted compliance notices resulted in the dismissal of a case.  For this reason, the Firm strongly urges clients to consider getting us involved right from the start before the notices are sent out.  This allows us to strategize with the client to figure out the best way to handle a tough situation.  We will actually draft the compliance notice for the client to make sure it gets done correctly, so the chances of success in front of the judge are increased.  This also allows us to prepare in advance for a trial -- which is crucial when the stakes are high on complicated and involved compliance cases.

4.    NON-EVICTION LEGAL ADVICE.
  We realize that legal issues often arise that are not directly related to evictions.  These situations are anything from neighbor disputes, problems with vendors, lease issues, etc.  While other law Firms charge on an hourly basis to handle these non-eviction matters, we do not.  Again, our policy is that we provide an overall service to our clients and the compensation is included in the Eviction fee.  So this means that if a client needs a letter written to a problem resident, needs help drafting a lease addendum, needs help settling a dispute with a resident over a lease issue, etc. the client will not be charged – this is a free service.  Only if the situation is going to be a complicated, on-going matter will the client be charged on an hourly basis.  However, before any hourly charges are incurred, the Firm will first notify the client in writing that the matter will be handled on an hourly basis.  In most situations though, there is no hourly charge.     As a further courtesy and service to our clients, we regularly answer personal legal questions for any person that works for a Firm client from maintenance technician to vice president.  This component of our service usually involves clarifying the legal issues for the individual, identifying what kind of attorney they will need to handle their matter, educating them on legal fees and costs to be anticipated, what kinds of questions to ask any attorney they are thinking of hiring, and referring them to an appropriate attorney.     Common issues are DUIs, divorce, family law, and restraining orders.  This is a value-added service that we have been providing for years.

5.    VALUE-ADDED SERVICES.  Exceptional value and reasonably priced service contributes to the continued growth of our client base and is a key factor for management companies who keep a close eye on overhead cost versus value received.  Whether it is a major company, or a smaller management team, they all know that the basic eviction fee provides them with these exceptional value-added services at no cost:

a. Educational Workshops and Materials We offer classes in both Basic and Advanced Fair Housing Training, Basic and Non-Monetary Advanced Eviction Training and client specific specialized workshops on topics ranging from immigration issues to subsidized housing and pest control.  We don’t just talk about putting on classes.  Our attorneys actually teach them.  Annually we teach approximately 65 FREE workshops with an average attendance of 50 per class, totaling more than 3000 attendees per year.   Additionally our legal team teaches CAM classes for both the AAMD and the AASC; and other industry specific programs for IROC, NARPM, BARHA, CHFA and the WCAA.

b.  Monthly Newsletter Every month the Firm publishes a newsletter, The Landlord News.  The newsletter contains articles written by the attorneys and addresses topics that are “hot” in the multi-family rental industry.  The newsletter also highlights common issues that arise in management and ownership and provides advice on how best to deal with such situations. The newsletter is distributed to all clients by e-mail or by facsimile if e-mail is not available and a print copy is sent out to clients by mail. We encourage clients to submit topics they would like to see in the newsletter. The newsletter is just another example of the service that the Firm provides to our clients, going above and beyond what any other eviction law firm does for their clients.

c. Monthly Luncheon (Metro Denver) & Quarterly (Colorado Springs) The nature of processing evictions results in meeting very few clients in person on a regular basis because most cases are processed by telephone calls only, with very little in-person contact. The Firm believed we could provide even better service and benefit by regular face-to-face meetings with all of the attorneys and staff in an informal setting. It affords attendees an opportunity to visit and exchange views with peers in the industry. After a presentation by the senior partner on a current industry hot topic or legal issue, clients are given and opportunity to ask or comment on any situation or topic of concern to them.  This open forum affords clients the opportunity to hear from others how they may have handled the same situation.  All clients are welcome and encouraged to attend.  Over 1200 clients annually attend our FREE Client Luncheons.
